Kaaya is an Advocate of the High Court of Kenya, a Commissioner for Oaths, and a co-founder of the firm. He holds a Bachelor of Laws (Hons) from Kabarak University, Diploma in Law from Kenya School of Law, and successfully completed Artificial Intelligence and Law course authorized by Lund University, Sweden.

After completing his post-graduate diploma, he undertook his pupilage at Mwendwa Mwinzi & Associates Advocates in 2019 and upon admission to the bar in 2020, he served as associate at the firm of Abdullahi Gitari and Odhiambo Advocates LLP. In 2022, he co-founded the firm and was appointed the inaugural senior partner.

His practice areas and interests are in commercial litigation, employment and labour rights, constitutional and administrative law, insurance, criminal and victims’ rights litigation, family law and succession, tax dispute litigation, procurement law, immigration law, and general litigation practice.

Experience

  • Has litigated on violations of constitutional rights to equality and freedom from discrimination, human dignity, freedom of expression and the right to assembly, demonstration, picketing and petition and right to property.
  • Has represented clients to their satisfaction and expectation in various commercial disputes ranging from debt recoveries, negotiation of settlements, breach of commercial agreements among others.
  • Has assisted clients in drafting, review, and negotiation of contracts.
  • Has advised clients on registration of various intellectual property rights such as trademarks, copyrights, patents, and utility models.
  • Has represented creditors in various insolvency proceedings contesting the unscrupulous and unlawful conduct of insolvency practitioners especially Administrators.
  • Has represented clients contesting administrative decisions infringing on clients’ rights to property.
  • Has represented clients in tax disputes ranging from under declaration, challenging agency notices issued by Kenya Revenue Authority, to interpretation of tax laws creating tax obligations on clients both at the Tax Tribunal and the appeals in the High Court.
  • Has likewise represented clients in employment disputes especially on unfair termination and wrongful dismissal from employment ensuring that the client’s labour rights are protected and obtain fair compensation.
  • Has also represented clients in family related disputes in children maintenance, adoption, burial disputes, guardianship of affairs and estate of the elderly and mentally sick, drafting of wills and codicils, and succession.
  • Has represented clients in personal injury and material damage claims against insurance companies in Kenya.
  • Has represented clients in fraud cases, murder, and manslaughter, obtaining by false pretences among other charges in various criminal courts in Kenya.
  • Has represented clients in electoral disputes in election courts.
  • Has assisted clients who seek immigration services such as Permits, Passes, Visas, Residence status and Citizenship.
